Avenavin.com Order & Usage Agreement
By requesting products or information (herein Content) from this web site, you acknowledge and agree to the terms and conditions set forth in this Agreement; 1) You are at least 18 years or older or have valid parental consent; 1a) You will not administer Content to any third party; 1b) You agree to use the Contents only as suggested or directed by your physician; 2) You understand that the Content has not been evaluated by the Food and Drug Administration; 3) You understand the Content is not intended to diagnose, treat, cure or prevent any disease; 4) You agree not to distribute, modify, adapt or otherwise make use of the Content, in part or in whole, for or to any third party person or entity; 5) To qualify for the 30 day product quality guarantee, return any damaged or defective product containers with a valid RMA number (obtained through the web site contact form) to the address on your billing Invoice. The package must be postmarked no later than 30 days from the purchase date. A one-time replacement shipment will be sent to you at no additional charge. No refunds or credits. Non-qualified returns are discarded. Upon receipt and processing of qualified RMA returns, the replacement shipment will be sent to the original delivery address. Credit card disputes are limited to fraudulent charges only. Chargebacks are not accepted as part of our 30 day replacement guarantee and will be disputed and collected. Additional chargeback fees may be applicable. Charges will appear as Avenavin.com on your credit card statement; 6) You agree to hold harmless, indemnify and defend - Avenavin.com, related companies, its officers, employees, principals, owner(s), manufacturers, affiliates, partners or other associates from any claims arising out of or in connection with the use of the Content or this web site; 7) You agree to use the Contents only as directed and to follow all label or insert instructions.; 8) You understand that the Contents herein are not a substitute for professional medical advise or treatment. Avenavin.com reserves the right to deny order fulfillment at it's sole discretion; 9) Replacement orders that are originally confirmed as delivered, but replaced for any reason, are final and non-returnable; 10) The Contents of this Agreement may be changed or updated, from time to time, with or without prior notice; 11) Defamation, threats or any inappropriate use of the Contents are strictly prohibited and considered a breech of this Agreement. Such activities may result in legal action against you; 12) GOVERNING LAW: This Agreement shall be governed by, construed, and enforceable in accordance with the laws of the State of Texas. Any and all actions arising out of or in connection with the Contents and/or this Agreement, shall be brought under jurisdiction in Texas and in no other jurisdiction; 13) Any part of this Agreement deemed unlawful shall be stricken, however, all remaining terms and conditions shall be considered valid and in full effect; 14) In the event of contradicting verbal, written or implied terms and/or conditions, this Agreement shall be the governing document for all purposes; 15) Results may vary.
